Merlin Technologies Inc. Limited Warranty (8/29/05):

Merlin Technologies Inc. warrants with this limited product statement, to the original purchaser for a period of one (1) year from the date of purchase, for product employed in Manufacturer's intended use and ordinary commercial applications for use in recreational darting:

Merlin Technologies Inc. warrants that the product will be free from defects in workmanship and materials during the warranted period. The product is manufactured from new components and parts or like-new components and parts; which perform like new and meet the specifications set forth in this manual.

Should your Merlin product prove defective during the warranty period, contact Merlin Technical service at: 1 800 669-9597 or service@merlindarts.com for warranty repair instructions. Merlin will at its discretion, repair or replace any part(s) on an exchange basis. When warranty service involves the exchange of the product or of a part, the item replaced becomes Merlin property. Any exchanged or replaced products or parts are warranted for the remainder of the original warranty period. Such warranty part(s), repairs or replacements are subject to the following conditions:

• Owner must ship (or otherwise deliver) the defective part(s) to the principal and enclose a brief description of the nature of the problem, the address to which the replacement part(s) should be shipped, the model name and unit serial number and verification of purchase date and ownership (copy of sales invoice).
• Owner is responsible for packing and shipping charges to the Principal.
• Principal reserves the right to substitute parts of equal or greater value and comparable function, in the event such parts have been modified or enhanced since the original owner's purchase.

The principal's warranty does not cover:

• Any failure caused by or resulting from abuse, neglect or accident: improper use, modification, service, maintenance or repair, or normal wear and tear.
• Cabinet exterior and decorative finishes, including scratches, scrapes and nicks in laminated surfaces.
• Installation or labor costs, in any form, incurred in any manner. Only part repairs or replacements are provided.
• Damages incurred in shipping, unpacking, set-up or installation.

This warranty covers only the intended, commercial, recreational use. This warranty does not cover third party parts, components or peripheral devices added to the Merlin product after its shipment from Merlin or its agents. Merlin is not responsible for warranty service should the Merlin labels or logo or serial number be removed or should the product fail to be properly maintained or fail to function properly as a result of misuse, abuse, improper installation, neglect, improper shipping, damage caused by disasters such as fire, flood, lightening, improper electrical current, software problems, interaction with non-Merlin products or service other than by a Merlin Authorized Service Agent. If a claimed defect cannot be identified or reproduced in service, the customer will be held responsible for costs incurred.

THE WARRANTY AND REMEDY PROVIDED ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESSED OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME LAWS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IF THESE LAWS APPLY, THEN ALL EXPRESS AND IMPLIED WARRANTIES ARE LIMITED TO THE WARRANTY PERIOD IDENTIFIED ABOVE. UNLESS STATED HEREIN, ANY STATEMENTS OR REPRESENTATIONS MADE BY ANY OTHER PERSON OR FIRM ARE VOID. EXCEPT AS PROVIDED IN THIS WRITTEN WARRANTY, NEITHER MERLIN OR ITS AFFILIATES SHALL BE LIABLE FOR ANY LOSS, INCONVENIENCE OR DAMAGE, INCLUDING DIRECT SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGE, RESULTING FROM THE USE OR INABILITY TO USE THE MERLIN PRODUCT WHETHER RESULTING FROM BREACH OR WARRANTY OR ANY OTHER LEGAL THEORY.

Dart Board
This warranty DOES NOT cover the Bristle Dart Board or any Electronic or Mechanical Coin Mechanism.

This warranty gives you specific rights, and you may also have other rights which vary from jurisdiction to jurisdiction.

Darboard Disclaimer

Merlin Technologies Inc.'s standard warranty does not cover the dart board.

Merlin Technologies Inc. warrants that the workmanship and materials used in the construction of this dart board are consistent with the existing specifications of the dart board manufacturer.

Merlin Technologies Inc. has modified this dartboard for use on its electronic steel-tip dart game. These modifications may alter some segments of the dartboard and these alterations, in and of themselves, do not qualify the dartboard as 'defective.'

If, upon receipt of the game or a new replacement dart board, there are any irregularities in either the materials, the manner in which they are assembled, or in the performance of the dart board; which cause the board to be unsuitable for recreational play, please contact Merlin Technologies or its Distributor for assistance.
